1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Mentors Care Services ("we," "us" or "our"), concerning your access to and use of our website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.
2. Services
Mentors Care Services provides childcare services, including but not limited to:
- Part-Time Nanny Services
- 24 Hours (Living Nanny) Services
- Japa Services
- Instant Booking (On-Demand) Services
The specific terms of each service, including pricing, duration, and responsibilities, will be provided to you upon inquiry and confirmed in a separate service agreement.
3. Booking and Payment
3.1 Booking Process
To book our services, you must provide accurate and complete information as requested. We reserve the right to refuse service to anyone for any reason at any time.
3.2 Payment Terms
Payment terms vary depending on the service selected:
- For Part-Time Nanny Services: Payment is due at the time of service or as specified in your service agreement.
- For 24 Hours (Living Nanny) Services: Payment is typically made monthly, with the first payment due before service commencement.
- For Japa Services: Payment is due as specified in your service agreement, typically with a deposit before service commencement.
- For Instant Booking Services: Payment is due at the time of booking.
All payments are non-refundable except as specified in our Refund Policy.
4. Cancellation and Rescheduling
Cancellation and rescheduling policies vary by service type:
- For Part-Time Nanny Services: Cancellations must be made at least 24 hours in advance to avoid charges.
- For 24 Hours (Living Nanny) Services: Cancellations require notice as specified in your service agreement.
- For Japa Services: Cancellations must be made at least 48 hours in advance to avoid charges.
- For Instant Booking Services: Cancellations must be made at least 2 hours in advance to avoid charges.
5. Service Provider Replacement
If you are not satisfied with your assigned childcare provider, you may request a replacement. We will make reasonable efforts to accommodate such requests, subject to availability.
If a replacement is not provided within 4 days of your request, you may be eligible for a partial refund as specified in our Refund Policy.
6. User Responsibilities
As a user of our services, you agree to:
- Provide a safe and healthy environment for our childcare providers
- Ensure proper accommodation, meals, and rest periods for live-in caregivers
- Communicate clearly about your expectations and requirements
- Treat our childcare providers with respect and dignity
- Make payments as agreed upon in your service agreement
- Provide accurate information about your children's needs, health conditions, and any special requirements
7. Intellectual Property
The Site and its original content, features, and functionality are and will remain the exclusive property of Mentors Care Services and its licensors. The Site is protected by copyright, trademark, and other laws of both India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Mentors Care Services.
8. Limitation of Liability
In no event will Mentors Care Services, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Site, any websites linked to it, any content on the Site or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
9. Indemnification
You agree to defend, indemnify, and hold harmless Mentors Care Services, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms and Conditions or your use of the Site.
10. Governing Law
These Terms and Conditions and your use of the Site will be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
11. Changes to Terms and Conditions
We reserve the right, in our sole discretion, to change, modify, add, or remove portions of these Terms and Conditions at any time. It is your responsibility to check these Terms and Conditions periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes.
